  1. Terms and Conditions:

    1. All work will be completed according to standard industry practices.

    2. Our estimate is based on normal work days and hours (Monday – Friday; 7:00am – 3:30pm). Saturday, Sunday, holiday and/or premium time hours are not included unless specified.

    3. Unless specified in the estimate or other contract documents, any permits, permit fees and/or inspection costs, traffic control and/or police traffic directors, if required, will be coordinated and paid for by the customer.

    4. If the customer claims tax-exempt status for this project, the customer will provide the proper certifications before work begins.

    5. All construction survey layouts of the proposed improvements are to be provided by the customer when needed.

    6. The customer is to provide sufficient, accessible space for our construction vehicles and equipment.

    7. Our estimate is based on being able to complete our work in one mobilization unless specified.

    8. All agreements are subject to strikes, accidents or delays beyond our control.

    9. The customer is to carry fire, tornado and other necessary insurance. Our company is fully insured.

    10. The above estimate is based on the type and quantity of work as explained or shown to our company representative. Any substantial deviation from the proposed work must be communicated to us immediately (before any additional work is executed) and may result in a revised estimate and/or a change order.

  2. Pricing:

    1. Payment terms are Due Upon Receipt unless otherwise specified.

    2. We reserve the right to change the pricing if this proposal is not accepted within 30 days of the estimate date. This estimate is based on material and labor costs in effect as of the date of this proposal.

    3. Any alteration or deviation from the above specifications causing extra work and/or costs will be executed only upon written orders and will become an extra charge over and above the estimate.

    4. It is mutually agreed and understood by the parties hereto that there will be 1.5% per month or 18% annual percentage rate charged in addition to the unpaid charges owing after a period of 30 days from the date they are due and owing.

    5. In the event that collection efforts are initiated against you, the customer, you agree to pay for all associated fees at the posted rates as well as all collection fees and reasonable attorney fees.

  3. Failure to start or resume:

    1. Downes Tree Service will properly complete the work provided for in each approved estimate

    2. If we are not able to start or resume the work, the customer will notify Downes Tree Service in writing that we must start or resume the work within seven (7) days or the customer will complete the work by other means.

    3. Absent default/breach by the customer, either in payment due, or the premises not being ready to start/continue the work, and/or if we are not able to begin or resume the work according to the customer’s requirements and an agreement is not reached, we must notify the customer via fax or a phone call (leaving a voice mail is sufficient) of said inability, and this agreement shall be of no further force or effect, EXCEPT the customer agrees to pay for the portion of work that was completed.
